Attend In-Person

Background

Original Applications

In 2021, the Town received proposed Official Plan Amendment (POPA 2021-0007), Draft Plan of Subdivision (21T-21002C) and Zoning By-law Amendment (RZ 2021-0013) applications from Rice Commercial Group on behalf of Tullamore Industrial GP Limited for lands located at 12245 Torbram Road. At the time of submission, the applicant was proposing an industrial park development consisting of warehousing, distribution centres and industrial uses in 12 industrial buildings totaling approximately 458,475 square metres (4,934,983 square feet). A public meeting was held on January 17, 2022.

Ministerial Zoning Order (MZO)

On January 17, 2022, Planning and Development Committee received a request for a Ministerial Zoning Order (MZO) on behalf of Tullamore Industrial GP Limited (Rice Group) for the above-noted lands. Committee referred the matter to staff to provide additional information and report back. The matter was not brought forward to Committee for further consideration, prior to the Minister of Municipal Affairs and Housing issuing an MZO on September 9, 2022 (Ontario Regulation 483/22). The MZO included additional lands which were not contemplated by the original development application and permits employment land uses on the subject landholdings. The subject landholdings were increased to 203 hectares (502 acres) with the MZO applying to the portion of the landholdings outside of the Greenbelt Plan. With the issuance of a MZO, the Zoning By-law Amendment (RZ 2021-0013) application is no longer required.

Revised Proposal

The applicant has submitted revisions to the Official Plan Amendment (POPA 2021-0007) and Draft Plan of Subdivision (21T-21002C) applications to reflect the new lands included in the MZO and change the proposed development. The Town is holding a new public meeting to discuss these changes. The Official Plan Amendment proposes to expand the settlement boundary and re-designate the lands from Prime Agricultural Area and Environmental Policy Area to Prestige Industrial, General Industrial, Rural and Environmental Policy Area. The proposed Draft Plan of Subdivision seeks to facilitate the development of an industrial park consisting of 20 industrial blocks, stormwater management blocks, environmental blocks, and internal streets. In total, the development is planned to include 9 industrial, warehouse and distribution buildings, with a total area of approximately 562,381 m2 (6,053,419 ft2).

Appeal Procedure

If a person or public body would otherwise have an ability to appeal the decision of the Council of the Town of Caledon to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Clerk of the Town of Caledon before the proposed Official Plan Amendment is adopted, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Clerk of the Town of Caledon in respect of the proposed plan of subdivision before the approval authority gives or refuses to give approval to the draft plan of subdivision, the person or public body is not entitled to appeal the decision of the Town of Caledon to the Ontario Land Tribunal.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Clerk of the Town of Caledon before the Official Plan Amendment is adopted, and/or in respect of the proposed plan of subdivision before the approval authority gives or refuses to give approval to the draft plan of subdivision, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
