Background

The Federal Government has jurisdiction over the production, distribution and use of medical marihuana. Under the new Marihuana for Medical Purposes Regulations (MMPR), as released by Health Canada in the Canada Gazette on June 19, 2013, commercial medical marihuana production is now legally permitted, subject to a federal licensing process. It is important to note that new federal regulations do not permit medical marihuana production sites to be located within a residential dwelling. It is also important to note that the regulations do not contemplate the retail sales of medical marihuana and prescribe stringent security requirements for these facilities, including limitations with respect to the distribution of medical marihuana produced at these sites.

Proposed Town-Wide Zoning By-law Amendment 

The Town's role in this process is to mitigate possible adverse land use impacts on citizens and local communities and to evaluate the future location of medical marihuana production facilities as any legal venture looking to locate in the Town.  The Town of Caledon has therefore undertaken a Town-wide Zoning By-law Amendment that will serve to implement Health Canada's new Marihuana for Medical Purposes Regulations regarding the future location of these facilities within the Town. The proposed amendment introduces new zoning provisions which generally include the following:

  1. Provide new definitions pertaining to Cannabis, Medical Marihuana and Medical Marihuana Production Facilities;
  2. Specify the appropriate zone(s) where a Medical Marihuana Production Facility may be permitted;
  3. Provide criteria for which a Medical Marihuana Production Facility may be established; and
  4. Other amendments to the Zoning By-law, as required.
