Closed Meeting Investigation

Section 239 of the Municipal Act, 2001, as amended, states that any individual may request that an investigation be undertaken to determine whether a municipality or local board has complied with the Municipal Act or its Council Procedural By-law in respect of a meeting or part of a meeting that was closed to the public.

Through Local Authority Services Ltd. (LAS) the Town of Caledon has appointed Amberley Gaval Ltd. as the Closed Meeting Investigator for the municipality. The Investigator will determine if the Municipality has complied with the Act or its procedural by-law in relation to closed meetings.

Under Section 239 of the Municipal Act, 2001 all meetings are open to the public, with exceptions permitted for the following reasons:

  • the security of the property of the municipality or local board;
  • personal matters about an identifiable individual, including municipal or local board employees;
  • a proposed or pending acquisition or disposition of land by the municipality or local board;
  • labour relations or employee negotiations;litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board;
  • advice that is subject to solicitor-client privilege, including communications necessary for that purpose;
  • a matter in respect of which a council, board, committee or other body may hold a closed meeting under another Act;
  • consideration of a request under the Municipal Freedom of Information and Protection of Privacy Act;
  • a meeting held for the purpose of educating or training the members of Council, local board or a committee provided that no member discusses or otherwise deals with any matter in any way that materially advances the business or decision-making of the Council, local board or committee.

Closed Meeting Investigation Procedure

Prior to submitting a request for investigation, members of the public, including corporations are encouraged to discuss their concerns with the Town Clerk.

Complaints may be submitted using the Closed Meeting Investigation form. All complaints must be submitted to the Town Clerk by mail, personal delivery or email and should be marked 'Confidential'. The following information must be provided:

  • Name of the Municipality
  • Full Name
  • Address
  • Telephone number
  • Email address (if applicable)
  • Date of the closed meeting
  • Provision contravened
  • Background information concerning the occurrence
  • Any other relevant information, including witness names and contact information
  • Original signature
  • Additional Information
