Bolton SPA Flood Risk & Planning Justification Report

September 26, 2017 Public Information Meeting


In 1979 the Province approved flood plain management policies that prevented development on flood plain areas entitled "Flood Plain Criteria - A Policy Statement of the government of Ontario on Planning for Flood Plain Lands". These policies provided detailed guidelines addressing the health and safety concerns of flood prone areas along various provincial water courses. Provincial policy normally does not permit development on flood plains; however, the Special Policy Area (SPA) provision of The Provincial Policy Statement (PPS) contained in section 3.1.3 describes areas where development could be permitted.

Official Plan Amendment 57 and By-law 85-65 established the Bolton SPA in 1985. The Bolton SPA designation received approval from the Ministry of Natural Resources (MNR) and the Ministry of Municipal Affairs and Housing (MMAH) in 1986.

The PPS defines a SPA as:

"... an area within a community that has historically existed in the flood plain and where site-specific policies, approved by both the Ministers of Natural Resources and Municipal Affairs and Housing, are intended to provide for the continued viability of existing uses (which are generally on a small scale) and address the significant social and economic hardships to the community that would result from strict adherence to provincial policies concerning development. The criteria and procedures for approval are established by the Province.
A Special Policy Area is not intended to allow for new or intensified development and site alteration, if a community has feasible opportunities for development outside the flood plain."

Study Area

The Study Area is located in the historic core of Bolton Rural Service Centre with the intersection of King St. W/E and Queen St. N/S approximately at the centre of the Bolton SPA. The Bolton SPA consists of various land uses including an Environmental Policy Area, Institutional, Low and Medium Density Residential, and a large area of commercial lands.
