Proposed Changes

The applicant has applied for an Official Plan Amendment to expand the settlement boundary and re-designate the lands from Prime Agricultural Area and Environmental Policy Area to Prestige Industrial, General Industrial and Environmental Policy Area. The proposed Draft Plan of Subdivision seeks to facilitate the development of an industrial park consisting of 5 industrial blocks, a future development block, a stormwater management pond, environmental block, and internal streets. In total, the development is planned to include 12 industrial, warehouse and distribution buildings, with a total area of approximately 458,475 m2 (4,934,983.83 ft2). The proposed Zoning By-law Amendment seeks to rezone the subject property from Agricultural (A1) and Environmental Policy Area 2 Zone (EPA2) to Prestige Industrial – Exception XXX1, XXX2, XXX3, and XXX4 (MP-XXX1, MP-XXX2, MP-XXX3 and MP-XXX4) and Environmental Policy Area 2 Zone (EPA2).

Appeal Procedure

If a person or public body would otherwise have an ability to appeal the decision of the Council of the Town of Caledon to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to the Clerk of the Town of Caledon before the proposed official plan amendment is adopted and/or before the by-law is passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at a public meeting, if one is held, or make written submission to the Clerk of the Town of Caledon in respect of the proposed plan of subdivision before the approval authority gives or refuses to give approval to the draft plan of subdivision, the person or public body is not entitled to appeal the decision of the Council of the Town of Caledon to the Ontario Land Tribunal.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to the Clerk of the Town of Caledon in respect of the proposed plan of subdivision before the approval authority gives or refuses to give approval to the draft plan of subdivision and/or before the proposed official plan amendment is adopted and/or before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
