Zoning By-law 2006-50
Caledon’s new Comprehensive Zoning By-law 2006-50 was approved by
Council on April 18, 2006 and came into effect on October 19, 2006. With some exceptions, By-law 2006-50 repeals
and replaces Zoning By-law 87-250. Other components of Caledon’s zoning program
include the proposed Environmental and Open Space Zoning By-law Amendment and
the Oak Ridges Moraine Zoning By-law. The Oak Ridges Moraine 2.B (2008-50) will
be incorporated into Zoning By-law 2006-50 when it’s fully approved. Until then, development within this areas
will continue to be regulated by Zoning By-law 87-250.
Caledon’s Official
Plan sets out the Town’s general policies for existing and future land
use. The Zoning By-law implements the
land use policies contained in the Official Plan and provides for their
day-to-day administration. Zoning By-law 2006-50 divides the municipality into
several land use zones. These are
illustrated on a series of maps attached as Schedules to the By-law. The By-law specifies the uses permitted
(e.g. residential, commercial, industrial etc.) and the development standards
(e.g., building size, location, height, parking provisions etc.) within each
zone.
By-law 2006-50 has not rezoned specific properties in Caledon nor
removed any use permissions that existed under Zoning By-law 87-250. Redundancies and inconsistencies identified
in By-law 87-250 have been removed, improving the way in which the Town’s
detailed and frequently complex zoning regulations and provisions are
expressed. The result has been the
creation of a new Zoning By-law which is more adaptive and responsive to
changing community development needs and contemporary development standards. In
particular, Caledon’s commercial and industrial parking requirements are now
much more competitive with other municipalities in the GTA.
The Zoning By-law contains specific, legally-enforceable
requirements. Construction or new
development that does not comply with the by-law may not be permitted. The Town will not issue a building permit
for development which does not comply with the provisions of the Zoning By-law.
However, where a proposed development fails to meet all the requirements of the
Zoning By-law but is otherwise considered to be acceptable, a Minor Variance or
a Zoning By-law Amendment may be required before the proposed development can
proceed.
By-law 2006-50 has been designed in an efficient, logical and
‘user-friendly’ format. In addition to
being available on the Town’s website, By-law 2006-50 is also available in
compact disc and traditional hardcopy versions.
